Car Finance and Misselling
Stormcatcher Law’s client bought a Mercedes Benz from a dealership that had advertised the vehicle as in pristine condition with no faults or issues. The client drove the car home dark, rainy conditions; on inspecting the car the next morning, he found the entire car was peppered with stone chips. He drove the car back to the dealership and rejected it. Believing the car’s condition to be commensurate with its age and mileage, the supplying dealer declined to accept the rejection.
On examining the evidence, Stormcatcher Law’s Philip Harmer took the case on as a second opinion following the client’s first solicitor’s failed efforts. After drilling down into the evidence, vehicle provenance, and circumstances surrounding the purchase, the client pursued the claim as a litigant in person, supported by Stormcatcher Law. The case was successfully settled at the court room door.
Dispute Resolution
Stormcatcher Law’s client bought a Toyota from a dealership for his limited company. The car was around a year old with low mileage, a full service history, and around 4 years of the manufacturer’s new vehicle warranty. However, following the purchase, the client was informed that the car was fitted with a CAN filter, enabling the UK registered Australian import car to display miles instead of kilometres. Concerned the car’s mileage was inaccurate, the client rejected the car, but the dealer declined to accept the rejection.
The client came to Stormcatcher Law for dispute resolution out of court. On inspection, Stormcatcher Law found various discrepancies with the deal including the manufacturer’s warranty being invalid due to the modification and an outstanding safety recall. After some time and effort, it was eventually agreed that the supplying dealer would buy the vehicle back from the client for the original purchase price.
Luxury Marques and Supercars
Stormcatcher Law’s client bought a Bentley from a prestige car dealership via Autotrader. The advert stated the car had a full service history, two specification packages, and was in excellent condition. The client agreed to purchase the car over the phone, paid the purchase price online, and utilised the dealership’s home delivery service. On receipt of the car, it clearly did not meet the online description. The client tried to cancel soon after delivery, but the dealership declined to accept the cancellation.
Stormcatcher Law advised the client of the dealership’s liability for misdescribing the car and successfully argued that the dealership had committed an offence liable on summary conviction to a fine which extends the right to cancel the contract beyond the standard 14 days. Eventually, the dealership accepted this, refunded the client the purchase price, the cost of the road tax, and Stormcatcher Law’s fees, and collected the Bentley.
